Dispute Resolution

The consultancy can provide an experienced practitioner to act as arbitrator, independent expert surveyor, mediator, court-appointed joint expert, expert witness and simply as a negotiator. We apply knowledge, experience and the facts of a case to resolve disputes connected with property, development, landlord and tenant, and matters relating to use and occupation of land.

We have a great deal of experience in the negotiation of agreements the psychology of ‘getting to yes’. Negotiations have covered numerous matters from property damages claims, partnership disputes on assets, landlord and tenant matters, development agreements, joint venture agreements, formation or special purpose vehicles for property development and a host of others.

Activities fall mainly into the following areas:

Arbitration: Determining disputes upon value (rental or capital);

Independent Expert: Similar to arbitration, reaching a decision on the value both having regard to the evidence of the parties and our own expertise in property values, appointed as for an arbitrator but also as a joint court appointed expert;

Expert Witness: Giving evidence at tribunals (court, public inquiries, House of Commons Select Committees, Lands Tribunal, arbitration, independent experts, planning inquiries, etc.), preparing expert evidence to comply with Civil Procedure Rules, RICS Practice Statement and Guidance Notes for chartered surveyors acting as an expert witness;

Negotiator: Representing a party to secure the best outcome of the case and advising on the cost effectiveness of proceeding to settlement in relation to the costs and risks.

Mediator: As a CEDR-accredited mediator, assisting the parties to a dispute to achieve a settlement in the most cost effective manner, exploring all the alternatives and seeking innovative and commercial ways in which to structure an agreement, with a long-term relationship.
